How Moving Scam Artists Collapse Binding Agreements -Part 5

Internet based scam movers rope in clients by offering initially low "binding" estimates. Then they use one or more sneaky and sometimes illegal techniques to trick the customer into accepting a higher price. To help consumers protect themselves from moving scams, Packing Service Inc. is publishing a series of articles describing the various tactics dishonest moving companies use to raise the final cost of the move.
In typical moving scam, the cheating company will give a low %LINK1%, usually over the Internet. Once the goods are loaded up, the dirt hits the fan, and the unwitting victim finds out that the price is now double or even triple, the original agreed on estimate. While many consumers agree to some type of binding moving cost estimate, they frequently are unaware of the many tricks moving companies use to annul the agreement and raise the price. For example, consumer regulations specify that any change in the agreed upon price must be noted in writing, before loading begins. Moving company con artists will use a whole range of tactics to get the householder to annul the agreement so he can raise the price.
In an earlier article in this series, I talked about ways in which moving companies add conditional clauses into the biding contract, to make it easy for them to raise the price later on, even if the customer refuses to sign on the day of the move. Here is an example of one company, that has used one variant of
this technique, successfully, on multiple moves. Here is a description of the company's technique, as described in the words of the victim:
"First, we were emailed a quote that said that packing materials would be extra, but the email did not state how much extra. We called the company to find out, and were told that for the amount of items we had, packing materials would be no more than $50-$100. Instead, we were charged an additional $1,000 for packing materials that no one even hinted we would need - even when we specifically asked in light of all our items. in the words of one customer."
The company arrived on moving day, and informed the client that the packing was unsatisfactory, and that they wouldn't be responsible for the safety of the items unless they were repacked. The contract has a clause which notes that packing materials are extra. The company quotes an expected price of $50 - $100 dollars for packing materials based on the naïve expectations of the customer that his packing will be sufficient for most of the items. The company, based on their experience, however, knows this isn't the case. If the customer subsequently takes them to court and accuses them of violating the binding agreement, the company will claim that the exclusory clause was clearly stated, and they had no idea the customer would require so much repacking. The customer may end up paying court costs and winning nothing.
One way to protect yourself from unexpected packing expenses is to hire a professional packing company.
