In the past the worker's compensation system in Texas was considered the worst in the nation. Conversely, alterations have been instilled within the system, and it has America's most severe rate of injured workers and the third most expensive compensation fees anywhere.

Texas also has an issue with a continually developing number of dropout physicians. Wrokers comp laws were overhauled by the government to create upgraded physician networks and add a small increase in payouts for injured employees. The revamped structure now in operation in Texas stands out as a great example for the rest of the United States.

Whilst in New York, the ideas that have so far been brought into discussion include limiting the duration of benefits for permanent partial disabilities to 10years. There has also been some discussion of raising the maximum weekly benefit to $500. Combining these two strategies could reduce the cost of premiums by roughly 15 percent.

New York remains hopeful that additional ideas and proposals will be observed by the government which can help to increase these benefits every more. Finding a middle ground on a benefit increase is the obvious ticket to solving workers compensation benefits. This would also help settle the current problems around back pain cases that are open ended.

California has already enacted similar reforms of its own workers compensation laws. Tremendous public sentiment to fix the system resulted in a massive petition to put the problem to a vote. Because of the overwhelming support from the public, lawmakers were forced into taking action themselves.

In order to reach workers compensation reform within New York without options for a petition drive, the key is to force leaders in the legislation to take action. Local legislators must let their leaders know that struggling businesses and stressed local governments see this as a priority.
